Terms of service 1 - Workshop Terms and Conditions
Client: You - The purchaser of the ticket
Business owner: Lisa Rogers
Event: This event focuses on lifestyle family photography

PAYMENT SCHEDULE:
Unless otherwise agreed, at the full balance of the total ticket cost is due 24 hours prior to the date of the event.
1.RELATIONSHIP OF THE PARTIES
This Agreement constitutes a contract for the provision of services and not a contract of employment. This Agreement shall not constitute or imply any partnership, joint venture, agency, fiduciary relationship or other relationship between the Parties other than the contractual relationship expressly provided herein.
CONFIDENTIALITY:
At all times, before, during or after the Event has been completed neither Party shall disclose any confidential information relating in any way to the past, present, or future business affairs, conditions, clients, customers, efforts, employees, financial data, operations, practices, products, processes, properties, sales, or services of or relating in any way to the The Business Owner in whatever form to any parties outside of this Event.
Confidential information means information that is of value to its owner and is treated as proprietary or confidential including, but not limited to, intellectual property, inventions, trade secrets or information, financial data or information, speculation, knowledge, general Company data or reports, future business plans, strategies, customer lists and information, client acquisition strategies, advertising campaigns, information regarding executives and employees.
The Client shall not disclose, whether for compensation or not, any confidential information obtained from the event to anyone unless required to do so by law.
MATERIALS:
No educational materials, presets or login information in any capacity can be shown, shared or resold by the client in any capacity. All material is for sole use only.
If the client is already is a photography educator, any new information learned within the course that they may want to use in their teaching will need to be taught of their own originality and not verbatim. The client agrees to reference the Business Owner for things learned directly from this course.
BOUNDARIES:
Business owner agree to uphold this contract to their highest effort, and work with the Clients with best interests. Promise to communicate honestly and see that work is done in a genuine way. All parties agree to respect certain boundaries as explained here:
All urgent communication before and after the event will be sent through email between the time of 9am - 6pm Monday to Friday; any messages received before or after those times will be dealt with at the next earliest convenience.
2.CANCELLATIONS
Tickets are payable in full 24 hours prior to the Event date. The Business Owner cannot accept attendance without full payment. The Business Owner does not accept responsibility for The Client being unable to attend for adverse or unforeseen circumstances. If the Event goes ahead on the intended date The Client will not be due a refund.
1. If the Client is canceling their attendance prior to the Event. The Client will not receive back any monies already paid but may resell and transfer their place to another person, this is the Clients own responsibility.
If the Client is unable to resell their ticket prior to the event and have completed the full payment they may still access the online 1-2-1mentoring portion of the ticket, the value and pricing course and receive the preset discount. However no refunds or partial refunds will be provided for non attendance.
2. If The Business Owner is forced to cancel or alter the Event due to unusual or unforeseeable circumstances beyond their control such as bad weather, war or the threat of war, riots, terrorist activity, civil strife, industrial disputes, natural or nuclear disaster, fire, flood, Ill health or government restrictions, The Business Owner will reschedule the event to a future date.
If the subsequent reschedule date makes it impossible for The Client to attend The Business Owner will provide a full refund.
3. All travel and accommodation choices are The Clients own responsibility. The Business Owner is not responsible for any travel or accommodation costs that the Clients also incur due to cancelation or alteration of the Event.
4. The Business Owner will do their best to ensure the Clients safety at the Event but they do not accept liability or responsibility for death, bodily injury or illness caused to any clients booking an Event with them. Any claims shall be subject to English Law in respect of any question of liability or quantum, and all proceedings shall be within the exclusive domain of the English Courts.
5. The Business Owner does not accept liability for any loss or additional expense caused by the delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the Client.
6. By attending this Event The Client gives their permission for images and video taken of them to be used to promote The Business Owners educational resources online and in print. (Excluding pornographic, defamatory, libellous or otherwise unlawful images and video)
7. By booking onto the Event with The Business Owner, The Client agree to these terms and conditions.
SUPPORTING NOTE TO CLIENT
As a business owner I am here to help, through giving you the best strategies I think are applicable to you in order to move your business forward and grow as an artist. It is expected that any financial numbers referenced via my education are not considered to be promise for your future expected earnings. Your results will vary and depend on many factors, including but not limited to your background, experience, geographic location and work ethic. All business entails risk, consistent effort and action. My ultimate goal is to help you achieve your version of success through giving honest feedback and advising applicable actions based on my own experience.
Terms of service 2 - Digital products and vouchers
.1 Introduction
1.1 These terms and conditions shall govern the sale and purchase of al Digital Products provided by And Then She Clicked
1.2 By placing and order with And Then She Clicked you give your express agreement to these terms and conditions.
1.3 These terms and conditions do not affect any statutory rights you may have as a consumer.
2. Interpretation
2.1 In these terms and conditions:
a) 'we' And Then She Clicked or ATSC
b) 'you' customer or prospective customer,
c) 'us', 'our' and 'your' should be interchanged with 'we' d) 'your' should be interchanged with 'you'
3. Order Process
3.1 Digital products are purchasable online via the website only, and available via download.
3.2 Please be sure that the products you are purchasing are compatible with software (requirements are listed on the individual Product pages)
3.3 After purchase, Products are delivered as a digital download. ATSC encourages you to make a backup copy of your downloaded Products, but no other copying or reproducing of Products is permitted.
3.4 Due to the digital nature of the products online digital products e.g presets, templates are non-refundable. This is detailed further in Section 7.
4. P r o d u c t s
4.1 Al images and/or photographs included in any of our products remain the full copyright of ATSC at all times.
4.2 Other than as expressly permitted by ATSC, Products may not be reproduced, modified, altered, for resale or re-distribution or sold, shared, sublicensed or transferred.
4.3 Any unauthorised use of the Website, Products or Images is an infringement of copyright and/or ATSC's intellectual property and proprietary rights. You are responsible for any fees, damages or compensation arising from any unauthorised use.
4.4 Replication of any products, information, settings or images for resale or sharing is Copyright Infringement and may be classed as a Criminal (IP) Offence.
4.5 Unless otherwise noted, the Website, Products and Images are the exclusive property and copyright of ATSC and are protected by national copyright laws, international treaty provisions and other applicable laws.
5. Prices
5.1 Our prices may change from time to time, but this will not affect contracts that have previously come into force.
5.2 All amounts and prices stated by ATSC are inclusive, and no additional tax is payable for UK orders unless otherwise stated.
5.3 If prices within our promotional material are incorrectly quoted, the price at checkout will be the correct one and we reserve the right to correct any mistakes within advertising. Incorrect promotional material pricing will not be granted.
6. Payments
6.1 Payments may only be made in the permitted methods as specified and declared by us.
6.2 If you request an unjustified charge-back via your payment method, then you will be liable to pay us, within 14 days following the date of our written request an amount equal to the amount of the charge-back; third party expenses incurred by us in relation to the charge- back, any applicable losses and expenses incurred in recovering the amounts e.g legal fees and debt collection fees. ATSC will rely on these terms to prevent any refund from being granted.
7. Cancellation Rights
7.1 Under the 'Consumer Rights Act' any 'distance and off-premises' orders made for a product deemed as 'Bespoke or Customised' are exempt from cancellation rights.
7.2 All digital products and downloads are non-refundable, with no exceptions. They cannot be returned for incompatibility or not being satisfied with the performance of any Product. This does not affect your statutory rights.
7.4 Gift Vouchers have 14 days after purchase to request a cancelation of the voucher; this is called the cooling off period. However, once we have completed the Photo Shoot you cannot change your mind, even if the cooling off period is still running . It will take up to 10 business days for any funds to be returned to your account after the request has been acknowledged.
7.3 We may cancel a contract under these terms and conditions by written notice to you if we are prevented from fulfilling that contract by any event beyond our reasonable control, include without limitation, any unavailability of raw materials, components or products, or any power failure, industrial dispute affecting any third party, government regulations, fire, flood, disaster, riot or war.
8. Warranties and Representations
8.1 You warrant and represent to us that you are legally capable and have full authority, power and capacity to agree to these terms and conditions and enter into binding contracts. You wil be able to take delivery of the products in accordance with these terms and conditions.
8.3 We warrant to you that:
a) we have the right to sell the products that you buy and that the products sold are don't not have any additional charge or encumbrance, except as specified in these terms and conditions.
b) You can enjoy quiet possession of the products you buy, except as specified in these terms and conditions.
9. Variation
9.1 We may revise these terms and conditions from time to time. A revision of these terms and conditions wil apply to contracts entered into at any time following the time of revision, but will not affect contracts made before the time of revision.
12. Law and Jurisdiction
12.1 These terms and conditions shall be governed by and construed in accordance with English Law.
12.2 Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
